These Terms & Conditions (“Terms”) govern the website, services, projects, transactions, and business relationship between Apotheosis Media, based in Asheville, North Carolina (“Apotheosis Media,” “we,” “us,” or “our”), and each customer, client, property owner, business, organization, or authorized representative (“Client,” “you,” or “your”).

By requesting a quote, approving a proposal, scheduling an appointment, paying an invoice or upfront payment, authorizing work, providing property access, or accepting or using our services or deliverables, you acknowledge and agree to these Terms to the extent permitted by applicable law.

These Terms should be read together with our Privacy Policy and any applicable quote, proposal, invoice, service agreement, statement of work, subscription agreement, or other written project terms.

  • Services requested

  • Number and type of deliverables

  • Travel requirements

4. CHANGES TO PROJECT SCOPE

Quotes and proposals are based on information provided before the project.

If the actual property size, property type, project location, condition, travel requirement, requested service, or scope materially differs from what was originally represented, Apotheosis Media may revise the price.

Additional work requested after a project has begun may result in additional charges.

Examples include:

  • Additional rooms or spaces

  • Additional square footage

  • Additional photography

  • Additional video

  • Additional scans

  • Additional floor plans

  • Additional editing

  • Additional travel

  • New deliverables

5. UPFRONT PAYMENTS AND DEPOSITS

Apotheosis Media may require an upfront payment, retainer, deposit, or full advance payment before reserving an appointment, traveling to a property, purchasing project-related services, or beginning work.

Unless Apotheosis Media expressly agrees otherwise in writing, any required upfront payment or deposit is NON-REFUNDABLE to the fullest extent permitted by applicable law.

An upfront payment may compensate Apotheosis Media for:

  • Reserving production time

  • Scheduling

  • Project preparation

  • Administrative work

  • Travel planning

  • Opportunity costs

  • Third-party costs

  • Initial project setup

  • Equipment preparation

  • Other costs incurred in anticipation of the project

Payment of an upfront amount does not prevent additional amounts from becoming due when the agreed project price exceeds the upfront payment.

6. PAYMENT

Payment terms may be stated on the applicable invoice, proposal, quote, subscription, or agreement.

Apotheosis Media may require:

  • Full payment in advance

  • A non-refundable upfront payment

  • A non-refundable deposit

  • Partial advance payment

  • Progress payments

  • Payment upon completion

  • Recurring payments

  • Subscription payments

  • Another mutually agreed arrangement

Payment may be processed through third-party payment providers, including PayPal and Square.

Supported payment methods may include credit card, debit card, ACH, or other payment methods offered by the applicable processor.

Clients are responsible for ensuring that payment information is accurate and that they are authorized to use the selected payment method.

7. NO-REFUND POLICY

ALL SALES AND PAYMENTS FOR SERVICES ARE FINAL AND NON-REFUNDABLE ONCE APOTHEOSIS MEDIA HAS BEGUN PERFORMING THE AGREED SERVICES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Apotheosis Media provides customized professional services involving reserved time, labor, travel, equipment, planning, processing, third-party technology, creative work, and other project-specific resources.

Accordingly, a Client is not entitled to a refund merely because the Client:

  • Changes their mind

  • No longer needs the project

  • Decides not to use completed content

  • Sells or leases the property before using the content

  • Changes marketing strategies

  • Dislikes a matter of subjective creative preference

  • Fails to download or access delivered content

  • Fails to provide information or cooperation

  • Cancels after work has begun

  • Chooses another service provider

  • Experiences business circumstances unrelated to Apotheosis Media’s performance

Once services have been substantially or fully performed, payment for those services is non-refundable to the fullest extent permitted by law.

Nothing in these Terms eliminates any refund, cancellation, warranty, or other legal right that cannot lawfully be waived.

8. THIRD-PARTY PAYMENT PROCESSORS

Payments may be processed through PayPal, Square, or another approved third-party payment processor.

Payment information submitted directly to these providers is processed according to the provider’s own terms, privacy practices, and security requirements.

  • Decline additional work

Any applicable late charges, collection costs, or interest will be imposed only where authorized by the applicable agreement and permitted by law.

Payment obligations for legitimately completed services survive project termination.

10. CHARGEBACKS AND PAYMENT DISPUTES

Clients should contact Apotheosis Media promptly if they believe an invoice or payment is incorrect.

A chargeback does not automatically eliminate a valid payment obligation.

If a Client initiates a chargeback or payment dispute concerning services that were properly authorized and provided, Apotheosis Media may submit relevant records to the bank or payment processor, including:

  • Quotes

  • Proposals

  • Invoices

  • Payment records

  • Communications

  • Appointment records

  • Property-access records

  • Project files

  • Delivery records

  • Proof of completed services

  • These Terms

  • Other documentation reasonably relevant to the dispute

Nothing in these Terms prevents a Client from exercising legitimate rights available through a card issuer, financial institution, payment processor, or applicable law.

11. SCHEDULING

Appointments are subject to availability.

Clients are responsible for providing accurate:

  • Property addresses

  • Contact information

  • Property sizes

  • Property types

12. CANCELLATIONS AND RESCHEDULING

Clients should notify Apotheosis Media as soon as reasonably possible if an appointment must be canceled or rescheduled.

Upfront payments and deposits are non-refundable where disclosed as such and permitted by applicable law.

Additional fees may apply when a Client:

  • Cancels after production resources have been committed

  • Cancels with insufficient notice

  • Repeatedly reschedules

  • Is unavailable at the scheduled time

  • Provides an incorrect address

  • Fails to provide property access

  • Provides inaccurate project information

  • Prevents Apotheosis Media from completing scheduled work

If Apotheosis Media agrees to reschedule a project, amounts already paid may, at our discretion and subject to the applicable agreement, be applied toward the rescheduled project rather than refunded.

13. TRAVEL AND OUT-OF-AREA SERVICES

Although Apotheosis Media is based in Asheville, North Carolina, we may provide services in other cities and states where legally and operationally appropriate.

Projects requiring travel may incur additional charges for:

  • Mileage

  • Fuel

  • Airfare

  • Lodging

  • Rental vehicles

  • Parking

  • Tolls

  • Transportation

  • Baggage or equipment transportation

  • Other reasonable travel expenses

Travel expenses may require advance payment.

Nonrecoverable travel costs incurred for a Client’s project are non-refundable to the extent permitted by law.

14. PROPERTY ACCESS AND AUTHORIZATION

The Client is responsible for ensuring that Apotheosis Media has lawful and timely access to the property.

By requesting services at a property, the Client represents that the Client owns the property or has sufficient permission or authority from the owner or authorized party to permit Apotheosis Media to enter and perform the requested services.

Apotheosis Media may decline to enter or remain at a property if we reasonably believe access is unauthorized, unlawful, unsafe, or materially different from what was represented.

16. PRIVATE, CONFIDENTIAL, AND SENSITIVE ITEMS

Photography, video, 3D scanning, and 360-degree imaging may capture substantial visual information.

Before services begin, Clients must remove, conceal, or secure items they do not want captured.

The Client is responsible for identifying areas or items that must not be photographed, recorded, or scanned.

17. OCCUPANTS AND THIRD PARTIES

The Client is responsible for appropriately notifying property occupants, employees, tenants, guests, contractors, or other individuals that photography, video recording, scanning, or other media production will occur.

The Client is responsible for obtaining permissions or releases where required by law or the intended use of the content.

18. PETS AND ANIMALS

Clients must safely secure pets and other animals when necessary.

Apotheosis Media may stop or postpone work if an animal presents a reasonable safety concern or materially interferes with production.

A reasonable delay does not automatically create a right to a refund.

24. REVISIONS

Apotheosis Media wants Clients to receive professional-quality final deliverables and will address reasonable revision requests according to the scope of the purchased service.

Unless a quote, proposal, invoice, or written agreement provides otherwise, revisions are limited to reasonable corrections or adjustments to the originally agreed deliverables.

Revisions are not grounds for a refund when Apotheosis Media can reasonably address an issue through correction or revision.

25. FLOOR PLANS AND MEASUREMENTS

Floor plans, measurements, dimensions, 3D models, and spatial information created through scanning technology are primarily visual and informational unless expressly stated otherwise.

Measurements may contain reasonable variances resulting from:

  • Equipment

  • Software

  • Property conditions

  • Inaccessible areas

  • Scanning conditions

  • Third-party processing

  • Other technical factors

Unless specifically contracted and professionally qualified for such purposes, Apotheosis Media’s floor plans and measurements are not professional surveys, architectural plans, engineering documents, appraisals, legal boundary determinations, or guarantees of exact square footage.

Clients should independently verify measurements when exact dimensions are material.

26. INTELLECTUAL PROPERTY AND COPYRIGHT

Unless expressly transferred through a separate written agreement, Apotheosis Media retains applicable copyright and intellectual-property ownership in original photographs, video, editing, creative work, and other original media created by Apotheosis Media.

Purchasing services does not automatically transfer copyright ownership.

After full payment, the Client receives the applicable license to use final deliverables for the agreed project purposes.

Matterport software, technology, trademarks, platform elements, and other third-party materials remain the property of their respective owners.

The Client is responsible for necessary licenses and permissions.

Apotheosis Media may refuse to use materials that reasonably appear unlawful or infringing.

30. PROJECT APPROVAL AND ACCEPTANCE

Clients are responsible for reviewing deliverables when approval is requested.

Material errors should be reported promptly.

Once work has been approved, published, transferred, downloaded, or otherwise accepted, later changes may constitute additional billable work.

Acceptance does not eliminate rights that cannot legally be waived.

31. CREATIVE SERVICES AND SUBJECTIVE PREFERENCES

Photography, videography, editing, composition, and other creative services involve professional judgment and subjective preferences.

Apotheosis Media will make reasonable efforts to follow agreed project requirements.

  • Displays

  • Devices

  • Browsers

  • Website compression

  • Printing

  • Lighting

  • Third-party platforms

  • Material breach of an agreement

  • Repeated failure to cooperate

  • Threatening or abusive conduct

  • Dangerous conditions

  • Unlawful requests

  • Safety concerns

  • Material misuse of our services

Termination does not eliminate legitimate amounts owed for services already performed or expenses already incurred.

40. GOVERNING LAW

These Terms and any dispute arising from or relating to Apotheosis Media’s services, website, transactions, or business relationship with a Client will be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.

  • Requested resolution

Nothing in this section prevents either party from seeking urgent legal relief when reasonably necessary or exercising rights that cannot legally be restricted.

43. NORTH CAROLINA AND OTHER CONSUMER RIGHTS

Nothing in these Terms is intended to waive or restrict rights that a Client may have under applicable North Carolina or federal law that cannot legally be waived.

If Apotheosis Media performs services in another state, mandatory laws applicable to that transaction may also apply.

Where a provision of these Terms conflicts with a non-waivable legal requirement, the applicable legal requirement controls only to the extent of the conflict.

44. SEVERABILITY

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Where legally permissible, an unenforceable provision may be limited or interpreted to the minimum extent necessary to make it enforceable.

45. NO WAIVER

Failure by Apotheosis Media to immediately enforce a provision does not automatically waive our right to enforce that provision later.
